1. Acceptance of these Terms
These Terms of Service ("Terms") are a legal agreement between you and The New Place, Inc. ("TheNewPlace.com," "we," "us," or "our") governing your use of thenewplace.com and any related apps (the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
These Terms work alongside our Privacy Policy, which explains how we handle your information.
If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. What the Service is (and isn't)
TheNewPlace.com publishes neighborhood and local-market guides for select U.S. metro areas — neighborhood overviews, commute times, climate and flood-risk information, property tax comparisons, and similar local research, intended to help people get oriented before a move.
We are not a real estate brokerage. We do not list properties for sale or rent, and we do not represent buyers, sellers, tenants, or landlords in any transaction. We also don't provide mortgage, lending, insurance, legal, tax, or financial advice or services, and nothing on the Service should be treated as a substitute for those. Figures and descriptions in our guides are compiled from public sources and other third-party publishers. They are not listings, appraisals, flood determinations, insurance quotes, tax bills, or school-assignment guarantees. See Section 9 and Section 9A for more on how to treat the accuracy of our content.
3. Who can use the Service
The Service is directed at users located in the United States and is intended for general audiences 13 and older (or the applicable minimum age in your state, if higher). If you're under that age, please don't use the Service.
4. Accounts
Account creation isn't available on the Service today. If we introduce accounts in the future, additional requirements may apply — for example, keeping your login credentials secure and providing accurate registration information — and we'll update these Terms to reflect them.
5. Acceptable use
When using the Service, you agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms;
- Scrape, crawl, or harvest content from the Service using automated means, except as permitted by our robots.txt or with our prior written consent;
- Copy, republish, or redistribute our guide content at scale, or present it as your own;
- Interfere with or disrupt the Service, its servers, or its security;
- Attempt to gain unauthorized access to any part of the Service or its underlying systems;
- Transmit malware or engage in any activity that could harm us or other users;
- Misrepresent your identity or affiliation, or impersonate any person or entity;
- Use the Service to build a competing commercial dataset, or to train a machine-learning model, by systematically copying our guide text, structure, or compiled tables, except as applicable law allows; or
- Circumvent rate limits, authentication, or access controls, or overload the Service with automated requests.
We may suspend or restrict access to the Service for anyone who violates these Terms.
6. Content and intellectual property
Unless otherwise noted, the text, design, graphics, and other original content on the Service are owned by TheNewPlace.com or our licensors and are protected by copyright and other intellectual property laws. You may view, print, and share individual guide pages for personal, non-commercial use — including sending a link to someone considering a move. You may not otherwise copy, modify, distribute, or create derivative works from our content without our permission.
Some content on the Service — including certain photographs — is used under a Creative Commons or other open license and is credited to its original source and license on the page where it appears. Use of that specific content is governed by its own license terms, not these Terms.
Feedback and error reports. If you email us a correction, source, or suggestion, you grant TheNewPlace.com a non-exclusive, worldwide, royalty-free license to use that material to operate, correct, and improve the Service. You still own your message. We will not treat your email address as public content.
6A. Third-party data, maps, and attribution
Our guides quote, summarize, or compute figures from third-party sources. Those sources are not our partners and do not endorse TheNewPlace.com. Their own terms govern the underlying data.
Depending on the page, sources may include official city, county, and state publications; transit agencies; school districts; the U.S. Census Bureau; NOAA climate normals; FEMA or other flood-related public datasets; and published research series from private publishers, including Zillow home-value research that Zillow makes publicly available.
We do not claim that any third-party publisher reviewed or approved our presentation. Where a source requires attribution, we provide it on the page where the figure appears. Where a source's terms limit redistribution, those limits control even if a page on the Service displays a figure derived from that source.
If we show map tiles, geocoding, or routing on the Service, that data comes from the map provider identified on the page or in the page source, and that provider's own terms apply to it. Distances and commute times are estimates, not guaranteed travel times.
7. Advertising
We display advertising on the Service through Google AdSense. Ads are provided by third-party networks and advertisers, not by us, and their presence on a page isn't an endorsement by TheNewPlace.com of the advertiser, product, or service being advertised. We do not control which third-party ads appear on the Service. If you believe an ad shown on the Service is unlawful or inappropriate, you can use that ad network's own reporting controls, and you're welcome to email us a screenshot and the page URL. 8. Third-party links and sources
Our guides cite and link to government agencies, transit authorities, school districts, and other outside sources, and may link to other third-party websites from time to time. We don't control those sites and aren't responsible for their content, accuracy, or practices. A link doesn't imply our endorsement of the destination.
9. Accuracy of information; disclaimer of warranties
Our neighborhood and market guides — including details on schools, commute times, flood and storm risk, distance to hospitals, property taxes, climate, and similar local facts — are compiled from public sources (such as government agencies, transit authorities, school districts, and the U.S. Census Bureau) and other third-party data, and are provided for general informational purposes only. Portions of this content, including research, drafting, and compilation, are produced with the assistance of artificial intelligence tools working from those same public sources. We make a good-faith effort to keep this content accurate and current, but local conditions, regulations, and figures change, and errors or omissions can occur.
This content is not a substitute for independent verification, professional advice, or your own due diligence, and it is not legal, tax, financial, or real estate advice. If you're relying on anything from our guides for a moving, purchase, or other significant decision, please confirm it with official local sources or a licensed professional first.
To the fullest extent permitted by law, the Service and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, secure, or error-free.
9A. Specific content limitations
Without limiting Section 9:
- Property taxes. Assessment ratios, millage rates, exemptions, caps, and special-district charges (including MUDs, PIDs, CDDs, and similar districts) change over time. Our cross-metro comparison pages explain general mechanisms; they are not a tax bill for a specific parcel and are not tax advice. Confirm current figures with the local assessor and a qualified professional.
- Flood, storm, and climate. Climate normals, flood-zone references, and storm-risk notes are general in nature. They are not a flood-zone determination, elevation certificate, or insurance quote. Lenders and insurance carriers rely on their own sources. Confirm current risk information with official maps and a licensed professional before you rely on it.
- Schools and attendance. Boundaries, ratings, and program availability change and can vary by address. School information is not a recommendation of any school and is not a statement about the people who live in a neighborhood.
- Commutes and distances. Times shown are typical or modeled estimates, not a promise about your particular trip, work schedule, or future infrastructure changes.
- Home-value and market figures. Published index, median, or trend figures describe a market or area as a whole, not the value of any particular home. They are not an appraisal.
- Local rules, HOAs, zoning, and insurance. Our summaries can lag changes in law or local practice. Always read the actual ordinance, HOA declaration, or insurance policy before relying on it.
If you're making a moving, purchase, sale, lease, insurance, or tax decision, confirm the current facts with official local sources or a licensed professional first.
10. Limitation of liability
To the fullest extent permitted by law, TheNewPlace.com and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of (or inability to use) the Service, even if we've been advised of the possibility of those damages. Our total liability for any claim arising from these Terms or the Service is limited to $100. This limit applies to claims arising out of the Service or these Terms, including claims that guide content was inaccurate or incomplete, except where applicable law does not allow the limitation.
Some jurisdictions don't allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
11. Indemnification
If you scrape or republish our content in violation of these Terms, impersonate us or another person, or use the Service in an unlawful way, you agree to indemnify and hold The New Place, Inc. harmless from claims, losses, and reasonable attorneys' fees that result from that conduct.
12. Fair housing note
TheNewPlace.com is committed to the letter and spirit of U.S. fair housing laws. We do not list or advertise specific dwellings, and we do not represent buyers, sellers, tenants, or landlords in any transaction.
Neighborhood and market guides are intended to describe amenities, housing stock, civic facts, commute, climate, taxes, and similar publicly sourced information. They are not intended to describe, rank, or steer readers based on race, color, religion, sex, national origin, disability, familial status, or any other characteristic protected by federal, state, or local fair housing law.
We aim for our neighborhood descriptions to be factual, evenhanded, and free of steering language. A separate Equal Housing Opportunity statement describes how we approach guide content and on-site advertising in more detail. That statement, and this section, are not legal advice.
13. Termination
You may stop using the Service at any time. We may suspend or terminate your access to all or part of the Service, without notice, for conduct that violates these Terms or is otherwise harmful to other users, us, or third parties, or for any other reason at our discretion.
14. Governing law and disputes
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service will be brought in the state or federal courts located in Georgia, and you consent to jurisdiction there. Either party may instead bring an individual claim in small-claims court in Georgia if that court has jurisdiction over it.
15. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice (such as a banner on the Service). Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

17. General provisions
Severability. If any provision of these Terms is found unenforceable, the rest of these Terms will remain in full effect.
Waiver. Our failure to enforce a provision of these Terms is not a waiver of our right to do so later.
Entire agreement. These Terms and our Privacy Policy make up the entire agreement between you and us about the Service, and supersede any prior understandings about it.
Assignment. You may not assign or transfer these Terms. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.
No third-party beneficiaries. These Terms do not create any rights for anyone other than you and us, except that our officers, employees, and agents may rely on Section 10 (Limitation of liability) and Section 11 (Indemnification) as intended beneficiaries.
Headings. Section headings are for convenience only and do not affect the interpretation of these Terms.
