This Privacy Policy explains how The New Place, Inc. ("TheNewPlace.com," "we," "us," or "our") collects, uses, shares, and protects information when you use thenewplace.com and any related apps (the "Service"). It applies to visitors, registered users, and anyone who submits a form through the Service — including tour requests, agent contact requests, and mortgage calculator/pre-qualification tools.
The Service is directed at users located in the United States and covers real estate listings within the United States. It is not directed at, and is not intended for, individuals located outside the United States.
By using the Service, you agree to the collection and use of information as described here. If you do not agree, please do not use the Service.
We and our partners use cookies, pixels, SDKs, and similar technologies for:
Your choices:
California/GDPR-style "sale" or "sharing" of data: Under California law (and similarly under some other state laws), allowing ad partners like Google to use cookies for personalized/interest-based advertising can legally count as a "sale" or "sharing" of personal information, even though no money changes hands for your specific data. See Section 7 for how to opt out.
We use the information we collect to:
We do not use your mortgage or financial information for any purpose beyond responding to the specific inquiry you submitted and, where you've consented, connecting you with a lending partner.
For users in jurisdictions that require a stated legal basis for processing personal data, we process your information based on: your consent (e.g., cookies, marketing communications), performance of a contract or steps you request (e.g., routing your tour request to an agent), our legitimate interests (e.g., improving the Service, preventing fraud), and compliance with legal obligations.
We do not sell your personal information for money. We do share information in the following circumstances:
This is central to how the Service works, so we want to be explicit about it. When you request a tour, ask a question about a listing, or otherwise contact an agent through the Service, we share the information you submitted (your name, contact details, and message) with the listing agent, brokerage, or their designated representative so they can respond to you directly. Once shared, that agent/brokerage's own privacy practices govern how they use your information — we encourage you to ask them about their privacy practices.
If you use a mortgage calculator, rate-quote tool, or request to be connected with a lender, we may share the information you provided with that lender or lending partner so they can respond to you. As of the date of this policy, we do not have any arrangement with a lender or lending partner under which we receive payment, a fee, or anything else of value for referring you. If that changes, this section will be updated to disclose it — and, separately, we'll put in place whatever Affiliated Business Arrangement disclosure federal law (RESPA Section 8) requires for that specific arrangement before it goes live.
We share information with vendors who perform services on our behalf, including: hosting and infrastructure providers, our MLS/IDX or listings data provider, analytics providers, advertising networks (including Google), email/SMS delivery services, and customer support tools. These providers are only permitted to use your information to provide services to us.
We may disclose information if required by law, subpoena, or other legal process, or if we believe in good faith that disclosure is necessary to protect our rights, your safety or the safety of others, investigate fraud, or respond to a government request.
If we're involved in a merger, acquisition, financing, or sale of assets, your information may be transferred as part of that transaction. We'll notify you (e.g., via notice on the Service) of any change in ownership or use of your personal information.
We may share aggregated or de-identified information that cannot reasonably be used to identify you, for purposes such as market analysis or reporting.
If you are a California resident, you have the right to:
To opt out of sale/sharing, or to exercise any right above, email us at the address in Section 14 with the subject line "California Privacy Request." We will not deny service, charge a different price, or provide a different quality of service for exercising your rights.
California's "Shine the Light" law: California residents may separately request information about our disclosure of personal information to third parties for their own direct marketing purposes. We do not currently disclose information for third parties' own direct marketing purposes; if that changes, this section will be updated.
As of the date of this policy, the following states also have comprehensive consumer privacy laws that may give their residents similar rights — to know, access, correct, delete, and opt out of the sale/sharing of personal information and targeted advertising: Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Tennessee, Minnesota, Maryland, Indiana, Kentucky, Rhode Island, Oklahoma, Alabama, and Vermont. More states are expected to pass similar laws over time; this list reflects our understanding as of the "Last updated" date above. To exercise applicable rights, email us using the information in Section 14.
Nevada residents may submit a request directing us not to sell certain covered information, though we do not currently sell personal information as defined under Nevada law. Email us at the address in Section 14 to submit such a request.
The Service is not directed to, and we do not knowingly collect personal information from, children under 13 (or under 16 where applicable state law sets a higher age for consent to data "sharing"). If you believe a child has provided us with personal information, please contact us and we will take steps to delete it.
We use reasonable administrative, technical, and physical safeguards designed to protect your information. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.
We retain personal information for as long as necessary to fulfill the purposes described in this policy: inquiry and lead information for as long as reasonably needed to respond to it and support the agent/lender relationship it created, account information for as long as your account is active, and usage/log data for a limited period for security and analytics purposes before it is deleted or aggregated. We may retain information longer where required to comply with legal, tax, or accounting obligations. Email us at the address in Section 14 if you'd like more detail about a specific category of information.
The Service may contain links to listing agents' own websites, brokerage sites, mortgage lender sites, and other third-party sites. We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies before providing them with information.
TheNewPlace.com is committed to the letter and spirit of U.S. fair housing laws. This document addresses privacy specifically; a separate Equal Housing Opportunity / non-discrimination statement governs how listings and advertising are presented, and isn't a substitute for legal advice on advertising compliance.
We may update this Privacy Policy from time to time. If we make material changes, we will update the "Last updated" date above and, where required by law, provide additional notice (such as a banner on the Service). Your continued use of the Service after changes take effect constitutes acceptance of the revised policy.
